  • The AI Act crea­tes a legal frame­work in Euro­pe, pro­hi­bits cer­tain prac­ti­ces and dis­tri­bu­tes obli­ga­ti­ons along the value chain.
  • The new­ly estab­lished Euro­pean AI Office (in DG CONNECT) and the Euro­pean Arti­fi­ci­al Intel­li­gence Board coor­di­na­te exper­ti­se, mar­ket sur­veil­lan­ce and GPAI risk assessment.

The AI Act aims to crea­te a frame­work for the use of arti­fi­ci­al intel­li­gence in Euro­pe by estab­li­shing a refe­rence frame­work for the rele­vant dis­cus­sion, pro­hi­bi­ting cer­tain prac­ti­ces and other­wi­se dis­tri­bu­ting cer­tain obli­ga­ti­ons among the links in the value chain.

The Gover­nan­ce in the area of AI at aut­ho­ri­ty level is loca­ted in seve­ral bodies:

  • The EU Com­mis­si­on should Euro­pean AI Office with the pur­po­se “to deve­lop Uni­on exper­ti­se and capa­bi­li­ties in the field of arti­fi­ci­al intelligence”;
  • the Euro­pean Arti­fi­ci­al Intel­li­gence Board is then for­med from repre­sen­ta­ti­ves of the mem­ber sta­tes. It has a coor­di­na­ting role, par­ti­cu­lar­ly in the area of mar­ket sur­veil­lan­ce, is a source of exper­ti­se in the regu­la­ted area, advi­ses the Com­mis­si­on and the AI Office, con­tri­bu­tes to uni­form appli­ca­ti­on in the Mem­ber Sta­tes, inclu­ding through recom­men­da­ti­ons, can draw up codes of con­duct and rules of con­duct and coor­di­na­tes with other stakeholders;
  • the Mem­ber Sta­tes desi­gna­te one aut­ho­ri­ty as the noti­fy­ing aut­ho­ri­ty and one as the mar­ket sur­veil­lan­ce authority.

The AI Office has now been repla­ced by the Com­mis­si­on by Decis­i­on C(2024) 390 from Janu­ary 24, 2024 has been set up. It has been inte­gra­ted into the Direc­to­ra­te-Gene­ral for Com­mu­ni­ca­ti­ons Net­works, Con­tent and Tech­no­lo­gies (“DG CONNECT”), fol­lo­wing the decis­i­on not to crea­te an inde­pen­dent aut­ho­ri­ty during the consultations.

Its tasks over­lap with tho­se of the Board and rela­te pri­ma­ri­ly to

  • Gene­ral Pur­po­se AI (GPAI) – here the AI Office is to deve­lop tools to assess the capa­bi­li­ties of GPAI, moni­tor the appli­ca­ti­on of the rele­vant requi­re­ments and moni­tor par­ti­cu­lar risks ari­sing from their use;
  • pro­hi­bi­ted prac­ti­ces and high-risk systems – here the AI Office has a coor­di­na­ting role and is a source of expertise.
