- The AI Act creates a legal framework in Europe, prohibits certain practices and distributes obligations along the value chain.
- The newly established European AI Office (in DG CONNECT) and the European Artificial Intelligence Board coordinate expertise, market surveillance and GPAI risk assessment.
The AI Act aims to create a framework for the use of artificial intelligence in Europe by establishing a reference framework for the relevant discussion, prohibiting certain practices and otherwise distributing certain obligations among the links in the value chain.
The Governance in the area of AI at authority level is located in several bodies:
- The EU Commission should European AI Office with the purpose “to develop Union expertise and capabilities in the field of artificial intelligence”;
- the European Artificial Intelligence Board is then formed from representatives of the member states. It has a coordinating role, particularly in the area of market surveillance, is a source of expertise in the regulated area, advises the Commission and the AI Office, contributes to uniform application in the Member States, including through recommendations, can draw up codes of conduct and rules of conduct and coordinates with other stakeholders;
- the Member States designate one authority as the notifying authority and one as the market surveillance authority.
The AI Office has now been replaced by the Commission by Decision C(2024) 390 from January 24, 2024 has been set up. It has been integrated into the Directorate-General for Communications Networks, Content and Technologies (“DG CONNECT”), following the decision not to create an independent authority during the consultations.
Its tasks overlap with those of the Board and relate primarily to
- General Purpose AI (GPAI) – here the AI Office is to develop tools to assess the capabilities of GPAI, monitor the application of the relevant requirements and monitor particular risks arising from their use;
- prohibited practices and high-risk systems – here the AI Office has a coordinating role and is a source of expertise.
