Artic­le 29 Working Par­ty: FAQ on the Pri­va­cy Shield for companies

The Artic­le 29 Working Par­ty has published FAQ for com­pa­nies on the EU-US Pri­va­cy Shield. The FAQ are dated Decem­ber 13, 2016, and are available here (PDF).

A Pri­va­cy Shield is not yet in sight for Switz­er­land. Howe­ver, the preli­mi­na­ry draft of the FADP (VE DSG) pro­vi­des in Art. 56 lit. b that the Fede­ral Coun­cil may con­clude inter­na­tio­nal trea­ties on the mutu­al reco­gni­ti­on of an ade­qua­te level of data pro­tec­tion. Accor­ding to the expl­ana­to­ry report, this pro­vi­si­on refers spe­ci­fi­cal­ly to the con­clu­si­on of an agree­ment to replace the Safe Har­bor Agree­ment, i.e. the con­clu­si­on of a CH-US Pri­va­cy Shield.
