Fede­ral Coun­cil wants to cla­ri­fy use of indi­vi­du­al data in com­pul­so­ry health insurance

Go to Par­lia­men­ta­ry initia­ti­ve “For the pro­tec­tion of pri­va­cy also in the super­vi­si­on of health insu­rance”. the Com­mit­tee for Social Secu­ri­ty and Health of the Coun­cil of Sta­tes (SGK-SR) wro­te a report (May 16, 2019, BBl 2019 5397 et seq.), on which the opi­ni­on of the Fede­ral Coun­cil has now been published (Media release from August 21, 2019; State­ment of the Fede­ral Coun­cil of August 21, 2019).

In it, the Fede­ral Coun­cil appro­ves the pro­po­sal of the Com­mis­si­on majo­ri­ty that the legal basis for the trans­fer of insu­red per­son data to the BAG “spe­ci­fi­ed” are to be:

The Fede­ral Coun­cil is of the opi­ni­on that the Fede­ral Office of Public Health (BAG) must be able to access aggre­ga­ted and, if neces­sa­ry, indi­vi­du­al data. This infor­ma­ti­on is essen­ti­al within the scope of its tasks, name­ly for the fur­ther deve­lo­p­ment of risk equa­lizati­on. The cur­rent legal pro­vi­si­ons alre­a­dy allow the coll­ec­tion of indi­vi­du­al data, but a more pre­cise for­mu­la­ti­on should ensu­re grea­ter legal certainty.

The Fede­ral Coun­cil also sup­ports the pro­po­sal of the Com­mis­si­on mino­ri­ty, which pro­vi­des for the pos­si­bi­li­ty of coll­ec­ting indi­vi­du­al data in the area of medi­cinal pro­ducts and means and artic­les. It belie­ves that the­se data pro­vi­de rele­vant infor­ma­ti­on, for exam­p­le to deter­mi­ne the sales gene­ra­ted by a new, very expen­si­ve drug at the expen­se of the man­da­to­ry health insurance.
