On the occasion of Data Protection Day, the federal and cantonal data protection authorities discussed common challenges in the areas of elections/ballots, police and AHV numbers on January 28, 2019.
- Elections/Votes: In the upcoming parliamentary elections next fall, those elected in the Guide from last December The principles formulated for data processing in the political context are being applied for the first time. The main aim is to make the use of digital media and technologies in elections (and votes) recognizable and comprehensible to the voter, thus taking into account the concern for a free and undistorted vote.
- Police: In the near future, the Federal law implementing the (EU) Directive 2016/680 (further development of the Schengen acquis) will enter into force. However, the Federal Council resolution required for entry into force is not yet available, and the date of entry into force has not yet been set. – In addition to various amendments to the laws applicable in the Schengen area in criminal matters, the new, little-known Schengen Data Protection Act will also be implemented; this will complete the first stage of the data protection law revision bill and implement the requirements of the Schengen acquis in the area of criminal law.
- Systematic use of the AHV numberWith a new directive currently in the consultation phase, the Adaptation of the AHV law it is intended to generally allow administrations at the federal, cantonal and municipal level to use the AHV number as an identifier outside the social security sector as well. This project is considered by the data protection authorities to be associated with considerable risks, which are to be taken into account with increased requirements for such processing, namely the obligation to conduct regular risk impact assessments.
