- The European Commission is examining an adjustment of the adequacy decisions and the standard contractual clauses for data transfers to third countries.
- The review is based on the agenda of the Article 31 Committee (Directive 95/46/EC) of October 3, 2016 and concerns specific draft decisions.
Like reported by Dr. Carlo Piltz on his blog delegedata, the European Commission is currently considering an adaptation of the adequacy decisions for third countries and for the EU Standard Contractual Clauses. This follows from the agenda of the Article 31 Committee under Article 31 of the Data Protection Directive for October 3, 2016. The Article 31 Committee is composed of representatives of the Member States who jointly take decisions when the consent of the Member States is required under the Directive. One of the agenda items is:
Draft Commission Decision amending Commission Decisions 2001/497/EC and 2010/87/EU on standard contractual clauses for the transfer of personal data to third countries and to processors established in such countries, under Directive 95/46/EC of the European Parliament and of the Council.
