e‑Privacy Regulation: Interim Status

As reported, the e‑Privacy Regulation initially dropped from the agenda after protracted negotiations. At the end of February 2020, however, the Council Presidency launched a new proposal. According to this proposal, probably the most important innovation is that the use of electronic communications metadata and the use of cookies (and the like) for the protection of legitimate interests will be made possible, subject to certain conditions (see also our report).

Since then, further negotiations have been delayed by Corona, according to a May 29, 2020, release of a Status report notes. The current Croatian Presidency of the Council is working with the new Presidency, which will take over on July 1, 2020. German presidency together to facilitate further negotiations.
