In its ruling of Octo­ber 6, 2015, the Euro­pean Court of Justi­ce declared the Safe Har­bor data pro­tec­tion agree­ment bet­ween Euro­pe and the USA inva­lid. The ECJ sta­tes that the trans­fer of per­so­nal data to the USA under the regime of the Safe Har­bor agree­ment is pro­ble­ma­tic. The agree­ment bet­ween Switz­er­land and the USA is also cal­led into que­sti­on by this decis­i­on. In the event of a ren­ego­tia­ti­on, only an inter­na­tio­nal­ly coor­di­na­ted approach invol­ving the EU will be effec­ti­ve for Switzerland.
