In its ruling of October 6, 2015, the European Court of Justice declared the Safe Harbor data protection agreement between Europe and the USA invalid. The ECJ states that the transfer of personal data to the USA under the regime of the Safe Harbor agreement is problematic. The agreement between Switzerland and the USA is also called into question by this decision. In the event of a renegotiation, only an internationally coordinated approach involving the EU will be effective for Switzerland.
