FDPIC – Opi­ni­on of the FDPIC on the decis­i­on of the Fede­ral Admi­ni­stra­ti­ve Court con­cer­ning the publi­ca­ti­on of com­mer­cial regi­ster data on the Inter­net by pri­va­te parties

In recent years, the Fede­ral Data Pro­tec­tion and Infor­ma­ti­on Com­mis­sio­ner (FDPIC) has recei­ved num­e­rous inqui­ries from data sub­jects regar­ding the publi­ca­ti­on of com­mer­cial regi­ster ent­ries on the Inter­net by pri­va­te com­pa­nies. In order to cla­ri­fy this mat­ter and crea­te legal cer­tain­ty, the FDPIC inter­ven­ed and sub­mit­ted the issue to the Fede­ral Admi­ni­stra­ti­ve Court for a ruling. In its ruling of 26 Febru­ary 2008, the Fede­ral Admi­ni­stra­ti­ve Court rejec­ted the FDPIC’s com­plaint, but nevert­hel­ess cla­ri­fi­ed num­e­rous issues and thus crea­ted legal cer­tain­ty for the per­sons concerned.
