As of today (September 15, 2017) Media release the FDJP has
- the draft federal law on the total revision of the Federal Data Protection Act and the amendment of other enactments on data protection (E‑DSG);
- the message on the E‑DSG;
- the draft federal decree on the approval of the exchange of notes between Switzerland and the EU; as well as
- the report on the summary of the results of the consultation procedure
published. The catalog of punishable acts and the amount of the fines have been reduced compared to the preliminary draft: The maximum fine is to be CHF 250,000 (instead of the CHF 500,000 provided for in the preliminary draft). The punishability of negligent acts has been waived.
According to the Federal Council, the bill is designed to be economically compatible, with the adjustments not going beyond EU legislation. The consultation was taken into account by refraining from a Swiss Finish. The FDPIC has today also issued a short statement dispensed.
