EU-US Pri­va­cy Shield: Com­mis­si­on con­firms adequacy

On Octo­ber 23, 2019, the Euro­pean Com­mis­si­on published its Report on the third annu­al review of the EU-US Pri­va­cy Shield, asses­sing the appro­pria­ten­ess of the Pri­va­cy Shield or the cer­ti­fi­ed com­pa­ny pro­tec­tion pro­vi­ded is con­firm­ed. At the same time, the Com­mis­si­on makes a num­ber of recom­men­da­ti­ons for fur­ther improvements.

At the same time, the que­sti­on of the ade­qua­cy of the Pri­va­cy Shield is pen­ding befo­re the ECJ (Case. C‑311/18). In the Schrems vs. Face­book case the Irish High Court refer­red the que­sti­on of the effec­ti­ve­ness of the EU-US Pri­va­cy Shield to the ECJ, among other things. The opi­ni­on of the Advo­ca­te Gene­ral is expec­ted on Decem­ber 12.
