On October 23, 2019, the European Commission published its Report on the third annual review of the EU-US Privacy Shield, assessing the appropriateness of the Privacy Shield or the certified company protection provided is confirmed. At the same time, the Commission makes a number of recommendations for further improvements.
At the same time, the question of the adequacy of the Privacy Shield is pending before the ECJ (Case. C‑311/18). In the Schrems vs. Facebook case the Irish High Court referred the question of the effectiveness of the EU-US Privacy Shield to the ECJ, among other things. The opinion of the Advocate General is expected on December 12.
