Euro­pean Par­lia­ment: Reso­lu­ti­on on trans­at­lan­tic data trans­fers (Pri­va­cy Shield)

On May 26, 2016, the Euro­pean Par­lia­ment announ­ced in a Press releasethat it is the Moti­on for a reso­lu­ti­on on trans­at­lan­tic data trans­fers (2016/2727(RSP)) of May 23, 2016. Accor­din­gly, the fol­lo­wing should be impro­ved in the Commission’s pro­po­sal on the Pri­va­cy Shield:

  • U.S. aut­ho­ri­ties’ access to per­so­nal data transferred;
  • The con­side­ra­ti­on of the prin­ci­ples of pro­por­tio­na­li­ty and neces­si­ty in the coll­ec­tion of data;
  • The lack of inde­pen­dence and insuf­fi­ci­ent powers of the U.S. Ombudsman;
  • The over­ly com­plex design of the appeals process.
