Liech­ten­stein: New data pro­tec­tion law in force as of Janu­ary 1, 2019

Accor­ding to Com­mu­ni­ca­ti­on from the Data Pro­tec­tion Office of the Prin­ci­pa­li­ty of Liech­ten­stein dated Janu­ary 7, 2019. the total­ly revi­sed Data Pro­tec­tion Act (DPA) has been in force sin­ce Janu­ary 1, 2019. Liech­ten­stein made use of the lee­way gran­ted to natio­nal legis­la­tures by the ope­ning clau­ses of the GDPR.

The struc­tu­re and con­tent of the total­ly revi­sed DPA fol­low the Ger­man Fede­ral Data Pro­tec­tion Act (BDSG) as a tem­p­la­te. The draft was not fol­lo­wed, among other things, with regard to the spe­cial obli­ga­ti­on to appoint a data pro­tec­tion offi­cer pur­su­ant to Artic­le 37 (4) of the GDPR (Sec­tion 38 of the Fede­ral Data Pro­tec­tion Act).
