Moti­on SPK‑N (19.3964): Legal basis for the dis­clo­sure of data to pri­va­te acci­dent insu­rance institutions

The Fede­ral Coun­cil is ins­truc­ted to sub­mit a draft amend­ment to Artic­le 97 para­graph 1 of the Fede­ral Law of 20 March 1981 on Acci­dent Insu­rance (UVG), by means of which the bodies ent­ru­sted with the Imple­men­ta­ti­on of this lawor the con­trol or super­vi­si­on of the imple­men­ta­ti­on of the plan. to dis­c­lo­se to pri­va­te acci­dent insu­rance insti­tu­ti­ons, under cer­tain con­di­ti­ons, tho­se data inclu­ding per­so­nal datawhich the­se are used for the coordi­na­ti­on of the assess­ment and cal­cu­la­ti­on of bene­fit claims requi­re. The data dis­c­lo­sed must con­cern the same occu­pa­tio­nal or non-occu­pa­tio­nal acci­dent or the same case of occu­pa­tio­nal dise­a­se and must rela­te exclu­si­ve­ly to the cir­cum­stances and dia­gno­ses asso­cia­ted with it. The data con­cer­ned must be spe­ci­fi­ed in the draft amend­ment, if necessary.

Justi­fi­ca­ti­on

The cata­log pur­su­ant to Artic­le 97 (1) UVG must be expan­ded accor­din­gly in order to gua­ran­tee effi­ci­ent coope­ra­ti­on bet­ween the man­da­to­ry acci­dent insu­rance and the pri­va­te acci­dent insurers.
