With regard to the draft of the new Fede­ral Sta­tis­tics Ordi­nan­ce, the Fede­ral Coun­cil is ins­truc­ted to sub­mit a draft of the new Fede­ral Sta­tis­tics Ordi­nan­ce to Par­lia­ment. For­mal legal basis which lays down the con­di­ti­ons under which the Con­fe­de­ra­ti­on may request the can­tons to pro­vi­de the neces­sa­ry infor­ma­ti­on for sta­tis­ti­cal pro­jects. Tax data can raise.

A mino­ri­ty (Ryser, Amoos, Andrey, Ben­da­han, Bert­schy, Gro­ssen Jürg, Mass­hardt, Roth David, Wer­muth) reque­sted that the moti­on be rejected.

State­ment of the Fede­ral Coun­cil of 2.4.2025

The Fede­ral Coun­cil is con­vin­ced that the Fede­ral Sta­tis­tics Act (BStatG) pro­vi­des a suf­fi­ci­ent legal basis for the intro­duc­tion of an exten­ded coll­ec­tion of can­to­nal tax data in the plan­ned Fede­ral Sta­tis­tics Ordi­nan­ce. As sta­ted in the opi­ni­on on the iden­ti­cal Moti­on 24.3514 Fel­ler, the Fede­ral Office of Justi­ce and an exter­nal legal opi­ni­on published on the web­site of the Fede­ral Tax Admi­ni­stra­ti­on come to this conclusion.

In order to meet the con­cerns expres­sed seve­ral times, in par­ti­cu­lar by various can­to­nal govern­ments, the Fede­ral Coun­cil is pre­pared to deve­lop a for­mal legal basis for the coll­ec­tion of can­to­nal tax data. Par­ti­cu­lar atten­ti­on will be paid to data pro­tec­tion and data secu­ri­ty (data rece­ipt, pseud­ony­mizati­on, data pro­ce­s­sing, data sto­rage, etc.). With such a for­mal legal basis, the Fede­ral Coun­cil belie­ves that any legal con­cerns regar­ding tax con­fi­den­tia­li­ty are no lon­ger necessary.
