Statement of the Federal Council of 2.4.2025
The Federal Council is convinced that the Federal Statistics Act (BStatG) provides a sufficient legal basis for the introduction of an extended collection of cantonal tax data in the planned Federal Statistics Ordinance. As stated in the opinion on the identical Motion 24.3514 Feller, the Federal Office of Justice and an external legal opinion published on the website of the Federal Tax Administration come to this conclusion.
In order to meet the concerns expressed several times, in particular by various cantonal governments, the Federal Council is prepared to develop a formal legal basis for the collection of cantonal tax data. Particular attention will be paid to data protection and data security (data receipt, pseudonymization, data processing, data storage, etc.). With such a formal legal basis, the Federal Council believes that any legal concerns regarding tax confidentiality are no longer necessary.
