The digital transformation of the working world is in full swing. Employees in the private sector as well as in public administrations are strongly affected by it.
Active participation in shaping these transformation processes is therefore of great importance for those affected. They should be involved both in the design and in the preparation of employees for these processes, such as further training. The involvement of employees in the impact of digitization has been implemented in recently concluded or renewed collective employment agreements (Swisscom, SBB), which have explicitly included co-determination in the digital transformation.
The Participation Act generally regulates participation in the workplace. However, it only applies to companies with 50 or more employees, and employees must actively demand participation, which is also limited.
With the digital transformation and the new technological possibilities, for example, the constant monitoring of employees is possible and is also practiced. This constant monitoring increases the physical as well as psychological stress of the employees. In very few cases are employees involved when monitoring tools are used. It is imperative to change this.
The Federal Council is requested in a Report to show how the Respect for employee rights implemented in digitization processes is and can be, namely in the private sector, but also in employment relationships under public law. In doing so, it should also point out possibilities for improving employee participation. The report should show how employee rights in Switzerland develop in comparison with OECD countries.
It must also be shown whether it is necessary for the Monitoring capabilities of employees needs clearer statutory requirements.
