In the cur­rent busi­ness on the “Amend­ment to the KVG regar­ding cost con­tain­ment mea­su­res – packa­ge 2” (busi­ness no. 22.062; in addi­ti­on here and here), Par­lia­ment has fina­li­zed the packa­ge. The Natio­nal Coun­cil and Coun­cil of Sta­tes pas­sed the amend­ments in the final vote on Fri­day, 21.3.2025, with almost no dis­sen­ting votes:

Under the new Art. 56a KVG, the (basic) insu­r­ers can, among other things

pro­vi­de tar­ge­ted infor­ma­ti­on on more cost-effec­ti­ve bene­fits, the choice of sui­ta­ble spe­cial forms of insu­rance and pre­ven­ti­ve measures.

Accor­ding to Art. 56a para. 2 KVG, insu­r­ers must inform insu­red per­sons of the pur­po­se of this infor­ma­ti­on “when they first make cont­act” and point out that rece­ipt of the infor­ma­ti­on is vol­un­t­a­ry and can be revo­ked at any time.

The new Art. 84 para. 1 lit. j KVG also aut­ho­ri­zes basic insu­r­ers to pro­cess per­so­nal data for the­se pur­po­ses. Howe­ver, pro­fil­ing for the­se pur­po­ses remains inad­mis­si­ble due to the lack of a for­mal legal basis.
