Schrems II – Update: EU aut­ho­ri­ties com­mu­ni­ca­te fur­ther procedure

On Sep­tem­ber 3, 2020, the EU Com­mit­tee on Civil Liber­ties, Justi­ce and Home Affairs (LIBE) on, among other things, the que­sti­on of how to pro­ce­ed after Schrems II. The respon­si­ble EU Com­mis­sio­ner and the Chair­wo­man of the Euro­pean Data Pro­tec­tion Com­mit­tee (EDSA) com­men­ted on the fur­ther action of their aut­ho­ri­ties. The EU Com­mis­si­on is curr­ent­ly in the pro­cess of revie­w­ing the stan­dard con­trac­tu­al clau­ses (SCC) and plans to revi­se it after the adop­ti­on pro­ce­du­re has been com­ple­ted (EDSA opi­ni­on, Comi­tolo­gy pro­ce­du­re) to fina­li­ze a new ver­si­on of the same by the end of the year. The EDSA will publish fur­ther gui­de­lines regar­ding data trans­fers that will con­ti­n­ue to be based on the SCC, which should ser­ve as gui­dance for com­pa­nies to imple­ment such data trans­fers in com­pli­ance with the GDPR.

It is also expec­ted that the FDPIC will also com­ment on the ruling next week.
