swiss­blawg has the Ruling of the BGer i.S. Swis­s­com con­cer­ning the civil lia­bi­li­ty of Inter­net access pro­vi­ders for copy­right inf­rin­ge­ments on the Inter­net sum­ma­ri­zed. The BGer comes to the con­clu­si­on that Inter­net access pro­vi­ders do not make a suf­fi­ci­ent con­tri­bu­ti­on to copy­right inf­rin­ge­ments by third par­ties mere­ly by pro­vi­ding access to the Inter­net. The­r­e­fo­re, joint lia­bi­li­ty through inci­te­ment or aiding and abet­ting can­not be considered.
