The Can­to­nal Data Pro­tec­tion Act does not app­ly to pen­ding pro­ce­e­dings in the admi­ni­stra­ti­on of civil, admi­ni­stra­ti­ve and cri­mi­nal justi­ce. In the area of the admi­ni­stra­ti­on of admi­ni­stra­ti­ve justi­ce, this also applies to the non-con­ten­tious first-instance pro­ce­e­dings. Inso­far as – under can­to­nal law – data pro­tec­tion dis­pu­tes rela­te to the penal system, the appeal to the admi­ni­stra­ti­ve court is inad­mis­si­ble pur­su­ant to Sec­tion 43(1)(g) of the Admi­ni­stra­ti­ve Juris­dic­tion Act.
